Almost certain postponement of elections in very small businesses

The CGT appealed in cassation to try to invalidate the candidacy of the Union of Corsican workers, which should lead to a postponement of the election.

The 4.5 million employees of companies with fewer than 11 people, who were from November 28 to December 12 to choose their representatives in future regional joint committees, will certainly have to take their troubles patiently. The reason? The CGT appeal against the judgment of the district court of the 15th arrondissement of Paris validating the candidacy of the Corsican Workers’ Union (STC), which should lead to a postponement of the election.

“This decision will have no impact on the measurement of union representativeness, which will take place in March 2017, but will necessarily have consequences on the schedule of the ballot initially scheduled,” confirmed Myriam El Khomri, Minister of Labor. In the next few days, the Director General of Labor will convene the High Council for Social Dialogue so that this body examines in the greatest transparency the consequences to be drawn from this situation. Once this procedure is closed, the government will do everything in its power to organize this election under the best possible conditions and as quickly as possible. ”

“Desolate situation”

If all the centers had joined together to bring the case to first instance, only the CGT decided to go to cassation. “The CFDT regrets that a dispute of this nature will disrupt the proper conduct of the elections,” reacted Marie-Andrée Seguin, its national secretary in charge of very small businesses. “This distressing situation is only the consequence of a too tight election calendar preventing a rigorous and coordinated work of exchanges, however qualified the CFE-CGC. This shortcoming was particularly cruel in the examination and validation of union applications and allowed the validation of a list that a serious and shared examination would have made it possible to rule out. “
